Advice on negotiating improved terms to the Settlement Agreement

For a Settlement Agreement to be legally binding, the law requires a relevant independent adviser to give the employee advice on the terms, the effects of the proposed agreement and its impact on the employee’s ability to pursue any rights before an employment tribunal. Through our Enhanced Service, we provide you with our Client Advice Letter in which we will:

  • Advise you on settlement parameters.
  • Analyse your legal claims and their prospects of success.
  • Consider with you the level of costs and other important considerations in relation to potential employment litigation.
  • Ascertain your best and worst case scenarios.
  • Consider your employer’s position.
  • Advise on tactics.

Having considered the above, and anything else that may appear to be important in relation to potential negotiations with your employer, we help you formulate your negotiating position. We normally expect to be able to provide this advice within 2 – 5 working days of receiving your instructions, employment documents and client ID, subject to the receipt of any further information that we request from you or advise you to obtain from your employer.

Negotiations with your Employer

We can:

  • Negotiate direct with your employer.
  • Negotiate with your employer’s solicitors.
  • Assist you in carrying out the negotiations for yourself.
  • Draft amended clauses to the Settlement Agreement to give effect to the negotiated changes to the agreement.
  • Prepare any related documents.

Negotiations may take a few days or, depending on what is at stake and the engagement of the parties, a couple of weeks. They will normally involve email and telephone correspondence, but there may be meetings (physically or via video conference) between the parties or their advisers. Occasionally, a third party facilitator such as ACAS or an independent mediator may be involved in assisting the parties to resolve their dispute.
