We explain the process from the receipt of your instructions to the completion of the Settlement Agreement.

Our Engagement Letter

First, we will send you a engagement letter:

  • This letter sets out the terms on which we will act for you.
  • We will confirm the scope of the service you requires (Standard or Enhanced).
  • We will confirm the basis of our charges and how these will be paid.
  • We will confirm the anticipated timescale for the work.
  • We will tell you what documents and information we will need from you.

If you are happy with the terms of engagement, we will ask you to confirm your agreement and the work will commence.

Our Client Advice Letter

After setting you up as client of the firm, we will check to ensure we have all the documents we need and then contact you to discuss the Settlement Agreement. This discussion can take place via video conferencing facilities, telephone or in person at our office. Following this discussion, we will send you our Client Advice Letter. This will:

  • Explain the purpose of the Settlement Agreement.
  • Set out your employment terms, so nothing is overlooked.
  • Ask you about the reason the Settlement Agreement has been offered to you.
  • Advise you on the possible claims against you Employer, including the likely levels of compensation.
  • Inform you about what would be involved if you were to bring proceedings in the Employment Tribunal or Court.
  • Consider with you whether there is scope to increase the amount offered in the Settlement Agreement.
  • Provide advice on the effect of the main clauses in the Settlement Agreement.

If, having received our advice, you wish to proceed to enter into the Settlement Agreement, we will ask you to confirm this to us in writing and then proceed to complete the agreement for you.

Signing and Completing the Agreement

As soon as you are ready to enter into the Settlement Agreement, we will send you the document in the form ready for signature.

  • If you wish us to do so, we will send the Settlement Agreement to your employer together with our Certificate of Advice. We will ask your employer to sign and date the Settlement Agreement and send a copy of this to us. We will send the completed Settlement Agreement on to you.
  • If you would prefer to complete the Settlement Agreement yourself, we will send you our Certificate of Advice for you to forward to your Employer with the Settlement Agreement signed by you. We will ask you to send us a copy of the completed Settlement Agreement for our file.
